Montesquieu's political theory, and his Spirit of the Laws in particular, has been considered a complex mosaic of varied and sometimes disparate intellectual traditions. Despite the forbidding structure of his works, important and impressive discussions of issues such as the justification of universal justice, a scientific approach to the law, a new typology of governments, a materialistic theory of climate, and the idea of a free state based on separate and balanced powers can be found there. After providing a short biography of Montesquieu, the chapter analyses his critique of despotism as well as the key themes of his mature political theory: the separation of powers, the three forms of government, the lessons of history, and the conditions of political liberty.

This chapter evaluates some of the central tensions that characterize Jean-Jacques Rousseau’s egalitarian account of sovereignty. He formulates this account as the basis for a participatory ‘social contract’, meaning a voluntary form of association that aims to be both general enough to include the people as a whole, yet concentrated enough to command their government and to over-power the divisive influence of a wealthy elite. As he argued in his main political works, if it is sufficiently forceful, such a collective will can counteract the forms of inequality and servitude that have accompanied the historical rise of propertied and exploitative classes. Rousseau’s radical conception of mass power would soon inspire the most uncompromising sequences of the French Revolution. However, its emancipatory promise was also limited by its author’s sexism, his anachronism, and his failure to engage with some emerging forms of inequality and power, notably those associated with the rise of commerce, capitalism, and the transatlantic slave trade.

Bentham is both an advocate of laissez-faire and an interventionist, a liberal rationalist and an equivocally liberal thinker prepared to sacrifice the rights of individuals to the well-being of the multitude. His ideas remain contested from all quarters, yet the outline of his actual political thought remains obscure. This chapter defends an interpretation of Bentham as an important liberal thinker with a commitment to the role of government in defending personal security and well-being, but also with a strong scepticism about government as a vehicle for harm as well as good. This chapter discusses his analysis of discourses and truth before considering the concept of power that informed his approach to sexuality and prisons. Critical questions about this concept raised in his 1975–1976 lectures ‘Society Must Be Defended’ led to its eventual abandonment in favour of a concept of power as government. This chapter examines the political theory and writings of French Enlightenment thinker, Montesquieu. It contends that Montesquieu’s constitutional theory of the separation of powers promoted a strong government which advanced individual freedom, maintained internal stability against absolutism and populism, and allowed the state to expand its boundaries at a moment in history when European powers were fighting each other to establish colonial empires across the world. The chapter presents the contexts in which he composed The Spirit of the Laws (1748), and then discusses Montesquieu’s typology of governments and considers the various notions of time and progress that undergird his view of how the various constitutions in the world are ordered. Finally, the chapter looks at commerce, peace, colonialism, and slavery, bringing to light the tensions and contradictions in Montesquieu’s thought.

14. Accountability in Parliament

This chapter focuses on the accountability of the government to Parliament. One way to conceptualize the place of the UK Parliament in the accountability process is as part of a ‘chain of delegation’, whereby democratic authority lies in the hands of the citizens. Due to lack of time and expertise to participate actively in the day-to-day process of running the country, however, these citizens delegate much of this responsibility to a subset of their number who become parliamentarians. Parliamentarians in turn delegate much of this role to a further subset of their number who become the government. The chapter first considers accountability in the Westminster model before discussing recent reforms of accountability mechanisms and how they have increased Parliament's capacity to scrutinize government. Examples of the strengthening of the accountability function include stronger select committees, the use of urgent questions, and Liaison Committee sessions with the prime minister.
