This chapter focuses on the so-called organized interests, whose interaction with the formal European Union (EU) institutions is a central component of the EU’s decision-making process. The term ‘interest group’ refers to a range of organizations outside of the formal institutions that seek to influence decision making. They provide a link between state actors and the rest of society, also known as ‘civil society’. The chapter first considers the general growth of interest group activity at the European level before discussing the types of group that try to influence EU policy making and the forms of representation open to interests. It then explores the strategies and tactics that interest groups use to try to influence the different institutions. Finally, it analyses the issue of regulating interest group access to the EU institutions.

This chapter examines the pattern of European Union (EU) institutions and the formal rules that govern them. It first considers the Treaties that form the founding ‘constitutional’ documents of the EU, from the Treaty of Paris to the Treaty on Stability, Co-ordination and Governance in the economic and monetary union (EMU), before turning to the main institutions involved in the processes of decision making, namely: the European Commission, the Council of the European Union, and the European Parliament, plus two consultative committees, the Economic and Social Committee and the Committee of the Regions. The chapter proceeds by analysing the Union method of decision making, focusing on the budgetary and legislative procedures, as well as the process on the Common Foreign and Security Policy. 9. Democracy and Legitimacy in the European Union

This chapter discusses the extent to which decision-making in the European Union can be considered democratic and legitimate, clarifying the concepts ‘democracy’ and ‘legitimacy’. The European democratic deficit became an important issue of debate only after the Maastricht Treaty transferred considerable powers to the EU. The main solution has been inspired by the parliamentary model of democracy and involves strengthening the European Parliament (EP), while also paying attention to the role of national parliaments and regional and local authorities. The chapter considers different stages of policy-making and different modes of governance, transparency and the role of civil society, and discusses wider issues associated with the democracy and legitimacy of the Union, such as the impact of the Constitutional Treaty and the Lisbon Treaty. The chapter concludes by warning that three main crises—the economic, migration, and security crises—have revived nationalist and populist movements exacerbating the challenges to the EU’s legitimacy.

It refers to the notion of EU institutional politics as the sphere of informal and formal rules, norms, procedures, and practices that shape such decision-making. The chapter explores how different theoretical traditions—international relations, integration theory, new institutionalism, the separation of powers, governance, public policy and administration approaches, and critical perspectives—think about EU institutions. 3. The European Council:

This chapter discusses the central role of the European Council in European Union (EU) politics and policymaking. Even though it was not listed among the EU’s core institutions until the Treaty of Lisbon, the European Council regularly intervenes in EU decision-making to make other institutional actors follow its guidance. Initially, it was meant to be predominantly an informal institution for direct exchanges between the heads of state or government of the member states. Yet it assumed responsibility for landmark decisions which paved the way for key steps in integration, such as EU enlargements and the euro. The European Council has arguably saved the Union from break-up by acting as its ultimate crisis manager and, at times, has skirted the boundaries of EU law by finding institutional compromises and fixes. The institution plays a guiding role, especially in relation to the Commission and the Council of the European Union, which was formerly known as the Council of Ministers. The European Council devises strategic guidelines for policy development, shapes processes of institutional reform, and breaks impasses when agreement cannot otherwise be found. Since the Treaty of Maastricht, European Council intervention has become a routine in new EU policy areas, such as euro area economic governance and foreign policy. The Treaty of Lisbon assigns the European Council its own full-time president and places the institution right after the European Parliament (EP) in the list of EU institutions. Even though it has shaped European integration since 1975, the European Council did not find much recognition in traditional theories of European integration. This has changed more recently, with renewed debate about intergovernmentalism in EU politics.

It argues that it is more productive to compare the Commission to national executives or to a government than to a secretariat of a traditional international organization. It begins with a summary of the Commission’s functions within the EU’s policy process. It then considers the question of Commission influence and autonomy, before moving on to look at the structure, demography, and decision behaviour within the organization—that is, at the role of the President of the Commission and the Commissioners, at the Commissioners’ personal staffs, and at the Commission administration. This chapter examines the European Union’s budgetary procedures with an eye towards elucidating the characteristics of budgetary politics and policy-making. Where EU money comes from, how it is spent, and the processes by which it is distributed are the subjects of intense political bargaining. Budgets matter politically, because money represents the commitment of resources to the provision of public goods and involves political choices across sectors and regions. The chapter first provides a thumbnail sketch of the EU budget before looking at the major players involved in the budgetary process. It then considers budgetary politics over time, focusing on two phases, one dominated by budgetary battles and the other by ordered budgetary decision-making, and shedding light on the EU’s large-scale budgetary response to the Covid-19 pandemic which marks an important step within the evolution of the EU budget. Finally, the chapter also provides an assessment of how the EU manages a larger budget.

11. The institutions of Economic and Monetary Union:
from the euro crisis to COVID-19

Since 1999, a subset of EU member states—known collectively as the euro area—has delegated exclusive competence for monetary policy to the European Central Bank (ECB), while giving limited powers to the European Commission, ECOFIN, and the Eurogroup in other areas of economic policy. The euro crisis provided the first major test of the Economic and Monetary Union (EMU), as a sovereign debt crisis spread between member states and threatened to tear the single currency apart. The ECB and two new institutions—the European Stability Mechanism and Euro Summit—helped to keep the euro area together but at significant economic and political cost. EU institutions were better prepared for the initial economic consequences of the COVID-19 pandemic, but the crisis still produced important institutional changes. The COVID-19 recovery fund Next Generation EU gives the Commission and Council a major new role in economic policy, albeit a temporary one for now. The EMU illustrates three key dimensions of EU institutional politics: the tension between intergovernmental versus supranational institutions, leaders versus followers, and legitimacy versus contestation. It also reveals the explanatory power of new institutionalism among other theoretical perspectives.

4. The Council of the European Union:
co-legislator, coordinator, and executive power

The Council is an institution of day-to-day policymaking in which the interests of member state governments are represented by cabinet ministers who meet, according to their policy portfolio, in different Council configurations and within the Eurogroup. According to the Treaty of Lisbon, the Council has a dual mandate. It acts as a legislative organ as well as an executive and policy-coordinating institution. This dual role is reflected in the organization and meeting practices of the different Council configurations. Those groupings of ministers dealing primarily with executive decisions and policy coordination tend to meet more often and are regarded as being more senior than those formations of the Council which engage predominantly in legislative decision-making. As a legislative institution, the Council has increasingly acquired features of an upper chamber in a bicameral separation of powers system, working in tandem with the European Parliament. In contrast, Council decision-making relating to executive issues and policy coordination in important policy domains, such as economic governance and foreign policy, is closely aligned with the European Council. In these areas, the Council can be considered to constitute, together with the Commission, a collective EU executive.
